The information and matching services provided by Sparq (developed by ByteStudio) are for general entertainment, socialization, and recreational purposes only. By using the App, you acknowledge and agree to the disclaimers listed below.
1. No Screening or Background Checks
Important Warning: Sparq matches users in real-time. We DO NOT perform criminal background checks, verify identities, or screen the historical records of users on our matching platform. We make no representations or warranties regarding the character, safety, background, or physical/mental health of other users you meet through the App.
You agree to exercise extreme caution and use common sense when interacting with matches, both inside the App (exchanging text, images, voice files) and in any potential off-platform communications. Never share sensitive personal data, such as your residential address, telephone number, financial credentials, credit card details, or workplace details, with other users.
2. User Content Disclaimer
We act as a passive conduit for the real-time transmission of chat messages, image drawings, and audio recordings. While we enforce strict reporting and banning mechanisms, we do not inspect all user communications in advance. We are not responsible or liable for any inappropriate, offensive, obscene, or unlawful content sent by other users. You assume all risks associated with viewing user-generated content during matchmaking sessions.
3. In-App Economy & Virtual Currency
The virtual currency ("Gems") used in Sparq does not constitute real-world monetary funds or store value. All acquisitions of Gems are purchases of a limited license to access specific software configurations. They cannot be transferred, sold, or traded for actual currency. Under no circumstances will ByteStudio issue cash refunds, chargebacks, or monetary compensation for Gems purchased or earned inside the App, including in the case of account termination, device bans, or service disruptions.
4. Service Interruptions and Socket Maintenance
We do not guarantee that our matchmaking socket servers will remain active, lag-free, or operational at all times. Service availability may be affected by server maintenance, network congestion, hardware failures, or force majeure events. We are not liable for any lost chat sessions, matchmaking delays, or missed push notification alerts.
5. "As Is" and "As Available"
Sparq is provided without warranties of any kind, whether express, statutory, or implied. ByteStudio disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of the App is entirely at your own risk.
