Please read these Terms of Service ("Terms") carefully before downloading, installing, or using the Sparq mobile application (the "App") operated by ByteStudio ("us", "we", or "our").

By accessing or using Sparq, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not download or use the App.

1. Eligibility and User Representation

To use Sparq, you must satisfy the following conditions:

• You must be at least 18 years of age (or the legal age of majority in your jurisdiction). The App contains live matchmaking features designed strictly for adults.
• You must possess the legal authority to enter into a binding contract under applicable law.
• You must not have been previously banned or suspended from our matching network.

2. Rules of Conduct & Content Standards

Sparq is designed to connect people in a safe and positive environment. You are solely responsible for the text, images, drawings, and voice messages you transmit during matches. You agree that you will not transmit any content or take any action that:

• Is sexually explicit, pornographic, or contains nudity.
• Contains hate speech, racial slurs, discriminatory comments, or threats of violence.
• Harasses, bullies, stalks, or defames other users.
• Promotes illegal activities, commercial solicitation, spam, or scams.
• Impersonates any person or entity, or misrepresents your age or identity.

Zero Tolerance Moderation Policy: We employ automated check/reporting pipelines and live moderation filters. If you are reported by other matches or flagged for abusive behavior, we reserve the right to immediately terminate your session, restrict your profile, and place a permanent hardware ban (using your Device ID) without prior warning. All decisions by our moderation team are final.

3. In-App Virtual Currency (Gems)

Sparq utilizes an in-app virtual currency called "Gems" to enable premium matching settings, gender filter overrides, name changes, or additional activities:

• Acquisition: Gems can be earned through rewarded actions (like ad spins/daily spins) or purchased with real currency through authorized payment processors (RevenueCat / Apple App Store / Google Play Store).
• Nature of Gems: Gems represent a limited, non-transferable, revocable license to access specific software capabilities. Gems have no real-world monetary value, do not earn interest, and cannot be redeemed, sold, or exchanged for cash or physical items.
• Non-Refundability: All purchases of Gems are final and non-refundable. In the event of account deletion, app uninstall, or hardware ban resulting from a violation of these Terms, all accumulated and unused Gems will be forfeited immediately, and no cash refunds or credits will be provided.

4. Disclaimers & Limitation of Liability

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that matching socket server connections will be uninterrupted, error-free, secure, or free from server drift or lag.

To the maximum extent permitted by law, ByteStudio and its directors, employees, or partners shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from (i) your access or use of the App; (ii) the behavior or content of other users; or (iii) any loss of gems, account data, or session history.

5. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your local jurisdiction, without regard to its conflict of law provisions. Failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

6. Termination

We may suspend or terminate your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will cease immediately.
